The Federal Court is committed to being more accessible to Indigenous people when they wish to bring legal disputes for resolution by the Court. For example, many Court hearings are held directly in the Indigenous community or via webcast from a Courthouse; and where appropriate, Court procedure is adapted to make space for Indigenous protocols and legal traditions. In selected cases, the Court also makes its decisions more accessible by having a summary prepared in the Indigenous language of the parties. The Court thanks the language keepers who assisted with preparation of this summary in Swampy Cree.

[1] Opaskwayak Cree Nation [OCN] asserts that it has suffered a wide range of impacts from the construction and operation of the Grand Rapids dam in West-Central Manitoba. It brought the present claim against Canada, alleging that Canada failed to comply with its fiduciary duty in the discussions that led to the expropriation of one of its reserves, which would be flooded by the dam.

[1] La Nation crie d’Opaskwayak [la NCO] affirme avoir subi un large éventail de répercussions découlant de la construction et de l’exploitation du barrage de Grand Rapids dans le centre-ouest du Manitoba. La NCO a intenté la présente action contre le Canada, alléguant que celui-ci a manqué à son obligation fiduciaire lors des discussions qui ont mené à l’expropriation de l’une de ses réserves, qui allait être inondée en raison du barrage.

[2] OCN’s action is allowed in part. The expropriation of the reserve gave rise to a fiduciary duty. The Court finds that in the particular circumstances of this case, that duty extended to the impacts of the dam on OCN’s way of life throughout its traditional territory, not only on the reserve. It required Canada to ensure that those impacts were mitigated or compensated. Canada breached its fiduciary duty by approving an agreement between OCN and Manitoba that made no provision for the mitigation or compensation of those impacts. The agreement was, therefore, an improvident bargain, resulting in a breach of Canada’s fiduciary duty.

[2] L’action de la NCO est accueillie en partie. L’expropriation de la réserve a donné naissance à une obligation fiduciaire. Compte tenu des circonstances particulières de la présente affaire, la Cour conclut que cette obligation s’étendait aux répercussions du barrage sur le mode de vie de la NCO sur l’ensemble de son territoire traditionnel, et non uniquement sur sa réserve. [3] OCN is entitled to receive equitable compensation for Canada’s breach. That compensation is based on the realistic lost opportunity caused by the breach that arose in 1962. What would have realistically taken place at that time is the negotiation of an agreement to mitigate or compensate the impacts of the dam for a limited period following the construction of the dam. The Court assesses the present value of such an agreement at approximately $27 million.

[4] The Court rejects OCN’s claim for a significantly larger amount based on a retrospective assessment of damages. Such a broad claim would have been unrealistic and anachronistic in 1962. Moreover, the evidence provided by OCN is insufficient to prove the damages it is seeking, is based on an unreliable methodology and fails to account for the fact that many factors other than the Grand Rapids dam may have contributed to cause the alleged impacts.

[4] La Cour rejette la prétention de la NCO à des dommages-intérêts beaucoup plus élevés, fondés sur une évaluation rétrospective du préjudice.
